H-1B Visa Holders Spouses Now Have Access to Work in the Us

US District Judge Tanya Chutkan has ruled that spouses of H-1B visa holders can work in the US after dismissing a lawsuit filed by Save Jobs USA seeking to dismiss the Obama-era regulation that allowed employment authorization cards to certain categories of H-1B visa holders' spouses. This comes as relief for foreign workers, especially foreigners in the US tech sector.


The lawsuit was challenged by industry Tech giants including Amazon, Apple, Google, and Microsoft. Almost a million H-1B spouses many of whom are Indian nationals have received work authorizations from the US. The H-1B visa program allows qualified foreign workers to work for American businesses, but until recently, H-1B spouses could not work, placing financial hardship on families.

Ajay Bhutoria, a well-known community leader and supporter of immigrant rights, applauded the court's ruling and said that it would simplify life for thousands of families across the country.

“Allowing H-1B spouses to work is not just a matter of economic fairness but is also a matter of family unity and stability,” he stated.

USCIS Director Ur M Jaddou has clarified that it is wrong to assume that laid-off H-1B visa holders must leave the country within 60 days.
