The International Air Transport Association (IATA), Airlines
for America (A4A), European Business Aviation Association (EBAA), and European
Regions Airline Association (ERA) have stated that the proposed flight
number reduction at Amsterdam Schiphol Airport (AMS) must not be put into
effect while a caretaker government is in place.
The airline industry is vehemently opposed to the suggested procedure, which is currently being reviewed by a judge. As a result, it cannot be said to be an issue without dispute.
The government's decision to reduce Schiphol flights to
460,000 through an "Experimental Regulation" has been deemed
unjustified, as it contradicts the Netherlands' obligations under EU
legislation and bilateral air services agreements. The government appealed and
reversed the decision, determining that the Balanced Approach does not extend
to the scope of the Experimental Regulation. The Balanced Approach is a legally
binding framework for managing noise concerns in airport communities, legally
binding in multiple national jurisdictions, including the EU and trade
partners. It aims to preserve local community interests, safeguard air
connectivity advantages, and uphold international actions. Rapidly moving such
significant cuts could lead to retaliatory international responses and legal
disputes, including those from governments defending their rights under
international agreements and bilateral treaties.
The caretaker government's and Minister Harbers' attempt to
hasten the flight reductions at Schiphol would be irresponsible on a number of
fronts, demonstrating a disregard for democratic and legal review and pitting
the Netherlands against its trading partners who are defending their rights in
accordance with international agreements and bilateral pacts.
