Canada is significantly tightening its eligibility criteria for open work permits for family members of international students and foreign workers, effective January 21, 2025. This policy shift aims to align temporary resident programs with the nation's economic priorities and address critical labour shortages.
Changes for Spouses of International Students:
Spouses of international students will only be eligible for an open work permit if the international student is enrolled in specific programs, namely:
- Master's programs with a duration of 16 months or longer.
- Doctoral programs.
- Select professional and eligible programs.
Changes for Spouses of Foreign Workers:
Eligibility for spouses of foreign workers is also being restricted. They will only be eligible if the foreign worker is employed in:
- TEER 0 or 1 occupation.
- Select TEER 2 or 3 occupations within sectors experiencing significant labour shortages or aligned with key government priorities. A comprehensive list of these eligible occupations will be made public on January 21, 2025.
Changes for Dependent Children:
Dependent children of foreign workers will no longer be eligible for open work permits under these new regulations.
