US Introduces New procedures to Accelerate Employment- Based Visas for Graduates

The Biden administration has announced plans to expedite the process of granting employment-based nonimmigrant visas to US college graduates who have received job offers, amidst the hectic election season. This guarantees that these graduates obtain their visas more quickly if they meet the requirements.


Visas for Employment-Based Nonimmigrants allow non-citizens of the US to work temporarily in the country. Only when a potential employer files a petition on the applicant's behalf will the visa be approved; the H-1B visa is one of the most common types of these visas.

The US Department of State will provide an updated protocol by July 18th regarding when consular officers should authorise the Department of Homeland Security (DHS) to issue an eligibility waiver. The waivers provide thoroughness and security while expediting the visa application procedure.

Depending on the grounds for the first rejection, certain candidates who have had their visas denied in the past may be eligible for a waiver allowing them to reapply for the visa. The Admissibility Review Office of US Customs and Border Protection and the DHS oversee these waivers.

To apply for a temporary worker visa, an employer must first obtain approval from US Citizenship and Immigration Services (USCIS) for a petition for a nonimmigrant worker (Form I-129). The employer will get a Notice of Action Form (Form I-797) as soon as the approval is obtained.

 The applicant can now proceed with the visa application by scheduling an interview with the US embassy and completing the online Nonimmigration Visa application (Form DS-160).
